Literally translated this term is "the thing speaks for itself"; that particular type of circumstantial evidence proven by showing the following three facts: a. That the instrumentality that injured the plaintiff was in the exclusive control of the defendant. b. That the plaintiff was not contributorily negligent. c. That the injury is one which does ordinarily occur unless someone is negligent.
